1. Scope of application

The following General Terms and Conditions (hereinafter "GTC") apply to all orders placed via www.bakedbymilo.com (hereinafter "Website"). The offer on this Website is directed exclusively at consumers domiciled in Switzerland (hereinafter "Customer").
A customer is a natural person who places orders on the website for private purposes. Orders in quantities not customary in the household may be rejected without justification.
These GTC can be changed at any time. The version of these GTC valid at the time of the order is decisive, which cannot be changed unilaterally for this order. Conflicting conditions or conditions of customers that deviate from these GTC will not be recognized.

3. Prices

Shipping costs are, unless otherwise provided, charged additionally and are to be paid by the customer. Shipping costs are shown separately in the order process.
Technical changes, errors and misprints are reserved, in particular the operator can make price changes at any time and without notice.
4. Conclusion of contract
The products and prices on this website are non-binding offers.
With the order via this website including the acceptance of these terms and conditions, the customer makes a legally binding offer to conclude a contract. The operator then sends an automatic order confirmation by email, which confirms that the offer of the customer has been received by the operator. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as the operator sends a declaration of acceptance by email, in which the shipment of the ordered products or services is confirmed.
Orders will only be shipped after full payment has been received and if the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, the Operator is entitled not to accept or only partially accept the order. In such a case, the operator will inform the customer by email. If the payment of the customer has already been received by the operator, the payment will be refunded to the customer. If no payment has been made yet, the customer will be released from the obligation to pay.
5. Payment options
The customer has the payment options specified in the order process. The operator reserves the right to exclude customers without giving reasons from individual payment options or to insist on prepayment.
6. Delivery, inspection obligation, defects and returns
Deliveries are sent by mail or courier service to the address specified by the customer in the order.
The operator strives to keep delivery times as short as possible. However, any delivery times stated in the order confirmation are not binding. The operator is entitled to partial deliveries. In this case, the shipping costs will be charged to the customer only once.
The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects, for which the operator is liable, immediately in writing by email to the address in the imprint.
Due to the perishable nature of the goods offered, a return to the operator is not possible.
7. Warranty and liability
The operator decides in case of defects without giving reasons and at its own discretion how defects will be remedied. The legal warranty is, as far as legally permissible, completely excluded.
The operator is liable exclusively for direct damage caused by its own gross negligence or intentional acts. Liability for third parties as well as for indirect damages and consequential damages is excluded. In particular, the operator is not liable if the obligations arising from these GTC are only partially or not completely fulfilled due to force majeure. Force majeure includes in particular attacks and explosions, epidemics and pandemics including the COVID-19 pandemic, uprisings, wars and riots, lightning strikes and fires, nuclear accidents, magnetic storms, strikes, the restriction or interruption of power supply and telecommunications services, floods and other natural disasters, officially ordered prohibitions and unforeseen weather conditions.
The limitation of liability pursuant to these GTC shall apply irrespective of the respective legal grounds. Any further mandatory liability, in particular for personal injury and in accordance with the applicable data protection and product liability law, remains reserved.
8. Further provisions
The operator is entitled to adapt these GTC at any time. The GTC at the time of individual orders apply.
The Operator is entitled to have individual or all rights and obligations arising from these GTC exercised by third parties or to transfer them to third parties.
These GTC as well as the contract are exclusively subject to Swiss law. For all disputes arising from or in connection with these GTC or the contract to which these GTC apply, the ordinary courts of Basel-Stadt shall have jurisdiction. Consumers may, in derogation thereof, choose between the court at their place of residence or at the place of business of one of the parties. Consumer contracts are contracts for services of normal consumption, which are intended for the personal or family needs of customers.
